Baycol Class Action Lawsuit Filed

Specter Specter Evans & Manogue, P.C. filed a medical monitoring class action suit August 17, 2001 in U.S. District Court against Bayer Corporation, whose corporate headquarters are located in Pittsburgh, Pennsylvania and Bayer AG, a global diversified chemical company based in Germany, in connection with the drug Baycol®, a cholesterol lowering drug.

The lawsuit alleges that Bayer Corporation should have been aware that Baycol® caused serious adverse reactions of elevated creatine kinase and liver enzyme levels. The increase in these levels indicates that a large number of muscle and liver cells are being destroyed, which could lead to rhabdomyolysis, kidney damage and/or failure, liver damage and/or failure, or death. These adverse reactions mirrored experiences of participants of controlled studies conducted by Bayer. The Complaint alleges that, notwithstanding this knowledge, Bayer pushed for approval of a higher dose of Baycol® without disclosing the true risks the drug posed and purposefully failed to inform prescribing doctors about the serious adverse reactions of Baycol®, or of the several deaths they knew about that had been linked to Baycol®. In the face of the increasing number of serious adverse events, Bayer belatedly removed Baycol from the market on August 8, 2001.

According to Dave Manogue of Specter Specter Evans & Manogue, "Baycol® may have severely compromised the health of thousands of people nationwide, and those people are entitled to have their conditions carefully monitored so that any problems caused by Baycol can be quickly assessed and effectively treated."
