Merck CEO to be Deposed in Vioxx® Suits

A New Jersey state court has ruled that plaintiffs' attorneys can depose Merck & Co. chairman and CEO Raymond Gilmartin in preparation for lawsuits against the company over its recalled drug Vioxx®.

In a report issued by the Associated Press a New Jersey Superior Court Judge ruled on December 16 that Gilmartin must answer questions as to how much he knew about the dangers of Vioxx® before his company abruptly pulled the drug from the market on September 30.

The AP quoted Merck attorneys as saying Gilmartin will likely be deposed sometime in March.

Merck is currently the defendant in over 457 lawsuits, including several that have been filed by state attorneys general, over its handling of the Vioxx® situation. The company is also being investigated by the Securities and Exchange Commission and the Department of Justice.
